Isle of Dogs Neighbourhood Plan Examiner's Report and Council's Response (Regulation 25)
This report notes the Isle of Dogs Neighbourhood Plan Report of Examination (Appendix 1) received on the 7th of June 2018 and the Examiner’s recommendation that the draft Neighbourhood Plan does not meet the basic conditions stipulated by legislation and therefore is refused and cannot proceed to referendum.
As required by the Town and Country Planning Act 1990 (as amended) this report considers the recommendations in the report and decides what action to take in relation to each and make a decision regarding whether the draft neighbourhood plan meets the basic conditions and legal requirements, or could meet the basic conditions and legal requirements, if modifications were made to the draft Plan.
To agree with the Examiner’s recommendations and therefore that the plan proposal be refused and not proceed to referendum.
As required by statutory deadlines, to make this within 5 weeks from the 8th of June.

Reason for urgency:
On Thursday 7th June, the Council and Forum received the final Examiner’s Report on the Isle of Dogs Neighbourhood Plan.
National legislation requires the Council to now make a decision with regards to the Examiner’s recommendations and come to our own conclusion as to whether the Plan meets the statutory requirements.
Statutory deadlines require this decision to be made within 5 weeks from the 8th of June. The Mayor has requested that for transparency, we bring the report to Cabinet on June 27th, as that is the only public meeting during the 5 week deadline.
For reasons of fairness and impartiality, we are not given an early indication of what the Examiner’s view would be until we and the Forum received his draft report for confidential fact checking. This was received on the 30th of May.
The statutory deadline and lack of pre-knowledge of the report meant that we were unable to publish a decision notice with 28 days’ notice in advance of the June 27th Cabinet meeting.

Consultation process
As required by legislation, two public consultations have taken place on the draft Neighbourhood Plan.
The first consultation, run by the Neighbourhood Forum, was held from 8th March 2017 to 19th April 2017 but the Consultation Statement states that the consultation period was not formally closed and they continued to receive and include comments after the formal end date.
The second consultation, run by the Council, was held from 11th January 2018 to 22nd February 2018.
Consultees
For the first consultation, hard copies of the draft Isle of Dogs Neighbourhood Plan were available to view at the Canary Wharf Idea Store and 5 drop in events were held during the consultation period. The documents were also available to download from the Isle of Dogs Neighbourhood Forum website and a link was provided on the Tower Hamlets Council website. The plan was sent to all the Consultation Bodies listed in Schedule 1 of the 2012 Regulations the Forum considered may be affected by the proposals.
For the second consultation, documents were made available at the Town Hall, Canary Wharf Idea Store, Cubitt Town Library and the Council’s Website. A public notice was published in the local press, and interested persons on the Council’s Planning Policy database were informed.
Has an Equality Analysis been carried out and if so the result of this Assessment?: No, EqIAs are only required when whenever a proposal is significantly changed or newly implemented. This report does not recommend a new proposal or significant change.
