Adoption of Regulation 123 List 2016 and Planning Obligations Supplementary Planning Document (SPD) 2016
PDF 82 KBApproval is sought from Cabinet on 6th September 2016 on the revisions made to the Community Infrastructure Levy (CIL) Regulation 123 List and Planning Obligations SPD.
The Planning Obligations SPD (2016) is intended to replace the current Planning Obligations SPD (2012). The revised CIL Regulation 123 List will replace the current list (April 2015).
The revised Planning Obligations SPD sets out the Council’s approach in securing Planning Contributions, outlining the restrictions of CIL Regulations 123 and 122 in order to understand the relationship and differences between CIL and Planning Obligations (also known as S106 obligations). The CIL Regulation 123 List sets out those matters that will not be subject to planning contributions as they are deemed to have been met by the developer through the payment of CIL.

These documents were made available for public consultation in 2103, April/May 2015 and May 2016. Directorates within the Council as well as the public were invited to make comments on the documents.
Has an Equality Analysis been carried out and if so the result of this Assessment?: No, an Equality Impact Assessment was carried in 2015 prior to the consultation on both documents April/May 2015. Subsequent changes to these documents following consultation are not substantive and therefore a new EqIA does not need to be carried out.
