Draft Revised Regulation 123 List and Planning Obligations Supplementary Planning Document
PDF 82 KBThe report is seeking approval of the revision to the Regulation 123 List and Planning Obligations SPD for public consultation.
These documents set out the Council’s approach to securing and spending the Community Infrastructure Levy (CIL) and Section 106 and the relationship between both types of funding. The Planning Obligations SPD explains the Council’s approach to infrastructure provision in general and explains which mechanisms will be used to mitigate the impacts of development and to secure specific types of infrastructure.
Consultation allows the public the opportunity to make representations to both documents. Following consultation, the adoption of the SPD and Regulation 123 List will provide clarity for applicants and the public on how infrastructure funding will be secured through S106 and CIL.

Consultation process
These documents were made available for public consultation in April/May 2015. Directorates within the Council as well as the public were invited to make comments on the documents.
The same consultation is being proposed, following revisions to both documents. It will be open to the public for a consecutive 5 week period, inviting comments on both documents
Has an Equality Analysis been carried out and if so the result of this Assessment?: No, an Equality Impact Assessment was carried in 2015 prior to the consultation on both documents April/May 2015. The changes to these documents are not substantive and therefore a new EqIA does not need to be carried out.
