Additional documents: Minutes: At the request of the Chair, Ms Kathy Driver, Principal Licensing Officer, introduced the report which detailed the application for a Temporary Event Notice for Vibe Bar 91-95 Brick Lane, London E1 6WL. It was noted that an objection had been received from the Police.
At the request of the Chair, Mr Lee Dicker, Director of Vibe Bar, briefly explained that the special cumulative impact policy did not relate to Temporary Event Notices and therefore believed that it was incorrect to apply it to this application. He referred to his statement and mentioned that he had been a part of Vibe Bar since it had opened, which was almost 18 years ago. He highlighted that the directors were very serious about the premises being a neighbourhood venue and have helped create significant improvement, regeneration and investment in the area.
He also added that with the current operating schedule, no drinks were allowed to be taken outside the premises after 10pm, no glasses are to be used, no re-entry after a specific time etc together with all other conditions on the licence, Mr Dicker did not feel that it would be attracting a crowd that would increase the crime and disorder and anti-social behaviour in the area.
Members then heard from PC Alan Cruickshank, Metropolitan Police, he stated that adding these additional hours to the Vibe Bar would attract more people to the area and by allowing these temporary event notices it would only exasperate the problems of alcohol related crime and disorder. He further explained that the hours fall within the peak hours for crime and disorder and public nuisance.
In response to questions, PC Cruickshank further explained examples of ASB in the area and how these would increase. It was also noted that recently there had no complaints or reported crime and disorder or anti-social behaviour relating specifically to the premises.
Members retired to consider their decision at 6.20pm and reconvened at 6.21pm.
The Licensing Objectives
In considering the application, Members were required to consider the same in accordance with the Licensing Act 2003 (as amended), the Licensing Objectives, the Licensing Guidance and the Council’s Statement of Licensing Policy.
Consideration
Each application must be considered on its own merits and after careful consideration the Chair stated that the Sub Committee had carefully listened to both Mr Dicker and PC Cruickshank. Members did not think it was appropriate or proportionate to refuse the application as there was no evidence to suggest that there was any specific public nuisance or crime and disorder linked to this premises which would lead to an increase in anti-social behaviour in the area. Therefore Members granted the application for a Temporary Event Notice.
Decision
Accordingly, the Sub-Committee unanimously –
RESOLVED
That the application for a Temporary Event Notice for The Vibe Bar, 91-95 Brick Lane, London E1 6WL be GRANTED.

It was noted that an objection had been received from the Police.
At the request of the Chair, Ms Jane Earl, Chief Executive for Rich Mix explained that they had, had only three TENs to date, when they have the ability to apply for up to 12 such extensions in a calendar year. She referred to her statement submitted to Members and explained that it was an Arts Council sponsored folk and world and music event, that they had worked well with the Police and local residents in the past, and were committed to being a good neighbour and as a result haven’t had any complaints/problems. Ms Earl concluded that there had been no significant anti-social behaviour caused by those visiting Rich Mix and believed that this event would not increase the crime and disorder or public nuisance in the area.
Members then heard from PC Cruickshank who stated that he had said in the past that there was no specific concern for the premises. However, highlighted that the hours applied for were during peak hours and an extra 400+ people in the Brick Lane area would have a significant effect on the number of people staying in the area whether it is to attend the late night eating establishments or to await transport home which at that time in the morning would greatly increase the chances of people shouting, dropping litter and hanging around to the early hours of the morning causing an increase in crime and disorder and public nuisance.
In response to a question it was noted that the event had successfully taken place twice before in the past two years and there had no reported problems.
Members retired to consider their decision at 6.40pm and reconvened at 6.41pm.
