Minutes: At the request of the Chair, Ms Lavine Miller-Johnson introduced the report which detailed an application for Bourbon/Kisses from Nonna, 387 Roman Road, London E3 5QR to vary the premises licence for an extension of licensable activities by an hour on Fridays and Saturdays and non-standard hours. It was noted that objections had been received by Environmental Health and local residents as well as a representation in support of the application.
Mr Paul Greeno, spoke on behalf of the Applicant and addressed each representation. He explained that there had been no history of prior noise complaints from the Premises.
Mr. Greeno explained that the applicant disagreed with the proposed noise conditions from Environmental Health, particularly the second condition, which restricted noise and vibration from becoming a public nuisance. He found this condition too vague, as it was already addressed by existing legislation.
Mr. Greeno dismissed Amit Patel’s submission as frivolous and vexatious, stating that Mr Patel was the son of the landlord of the building where the Premises were located. That Mr Patel had previously attempted to have the business rates reassessed by classifying the Premises as a bar rather than a restaurant, which would have changed the property’s tax valuation.
Mr. Greeno clarified that live music occurred once a week, finishing by 10:30pm, and that recorded music was played at a low volume as background music to create ambiance, without causing significant noise disturbances.
Members then heard from Mr. Olere, Environmental Health Officer who spoke on behalf of Nicola Cadzow. He referred to her representation and read out the statement in the agenda pack.
Members also heard from Mr. Prebble who spoke in support of the Premises. He said he lived in close proximity to the premise. Mr. Prebble stated that no crime was associated with the Premises and there were no issues regarding the protection of children from harm.
In response to questions the following was noted;
- That the business operated as an American diner. - Mr. Greeno acknowledged that he could not definitively prove Mr. Patel's submission was frivolous, but on the balance of probabilities it was more likely than not. He explained that some photos taken when the Premises were open but it was unclear as to whether the individuals were customers or passersby. - That the conditions proposed by the Police needed to be reasonable and proportionate and related to the variation request. As the police had asked for SIA staff from 9:00pm every night, but the variation only applied to two nights after 11:00pm and therefore this request for condition was disproportionate. - That the premises currently closed 30 minutes before 11:00pm to allow for drinking up and dispersal. - That a noise assessment had been conducted, by a noise engineer who was a customer and he had advised that noise levels were not a concern and was of a low decibel. - That the applicant would only be playing low background music and therefore the applicant was willing to withdraw the request ... view the full minutes text for item 4.2 |
