Authorisation of the PUBLIC SPACES PROTECTION
ORDER No 1 2021 (an extension of NO 3 of 2017) – ALCOHOL
CONTROL ZONE (Sections 59 to 75 Antisocial Behaviour, Crime and
Policing Act 2014)
Reasons for the decision:
The PSPO No 3 2017 Alcohol Control Zone was
itself preceded by a Designated Public Place Order (DPPO)-Alcohol
Control Zone, which was issued under previous legislation. The 2017
Order was the instrument that was permitted to be used to transfer
the DPPO. Since then, stakeholder engagement and consultation,
which included police, community representatives and
representatives of businesses plus other data, confirmed the
success of the order and the need to extend it for a further three
years to manage the antisocial behaviour associated with the misuse
of alcohol.
Alternative options considered:
Not to extend the order for a further three
years. Rejected for the reasons of the result of the consultation
and data indicating the success of the order and if not extended,
the removal of important powers available to council and police
officers through the PSPO, to manage issues of antisocial behaviour
associated with the misuse of alcohol.
