The Council is seeking to make an Article 4
direction which would remove permitted development rights for the
change of use of E-class uses to residential (C3 Use Class).
The Article 4 direction would result in the need for planning
permission to be obtained for the above changes of use.

Reason for urgency:
To ensure that the timescales required for Cabinet approval do not result in increased risk permitted development rights being exercised that would be contrary to LBTH’s objectives, particularly where they relate to the safeguarding of office/industrial and town centres uses and activities. Existing permitted development rights attached to uses now within Class E will expire 31 July 2021, which means the existing Article 4 directions removing the office to residential and retail to residential permitted development rights in our designated locations will expire on the 1 August 2022. If we are to seek approval to make the Directions at (22) September Cabinet with a call-in on 1 October, there is a period of risk to the PD rights allowing change of use in our designated office/industrial and town centres uses as identified in the Local Plan. The Article 4 must be made as close to 1 August 2021, to reduce risk of prior approval applications coming forward ahead of a new direction.
