Council response
The Council has already provided FOIG with extensive information on the land in question, being the land which includes the Calder’s Wharf Community Centre, title number EGL502269, since the matter was first brought to our attention on 1st March 2017.
The Council has responded to two Freedom of Information requests from FOIG, the first on 26th February 2018 and the second on 23rd July 2018. FOIG were informed in the first response of the legal status of the land, and that it no longer enjoyed open land status at the time of the transfer, and that the Council were under no obligation to hold or administer the land as open space under the Open Spaces Act 1906.
The land in question is owned by East End Homes Limited as a
result of a stock transfer from the Council. This was decided at a
Cabinet meeting on 5th October 2005 and FOIG have already been
provided with this report. The exchange took place on 16th January
2006 and a copy of the transfer document is available publicly at
the Land Registry. A copy of this transfer has also previously been
provided to FOIG.
According to the Land Registry portal and an official copy of the
register relating to the freehold title EGL502269 there is a
pending application on behalf of Telford Homes PLC to register a
999 year lease granted by East End Homes and dated 09th December
2016.
As East End Homes Limited is the proprietor of the land in
question, it is not possible to re-assert public ownership of the
land.
